Brief Synopsis
Arbitral Awards are intended to be Âfinal and binding. Malaysia in adopting the UNCITRAL Model Law has provided for limited circumstances where the Arbitral Awards may be challenged. These avenues for challenge are statutorily provided for under the Malaysian Arbitration Act 2005. This talk will specifically discuss the provisions and the leading cases where Arbitral Awards were set aside under these limited circumstances.
The Speakers
LAM KO LUEN
Ko Luen is a Partner of Messrs. Shook Lin & Bok and he heads the firm’s Building, Construction and Engineering department. He is also the Deputy Head of its International & Domestic Arbitration department. He is the Past President of the Malaysian Institute of Arbitrators (“MIArbâ€) [2013-2015]. He appears as counsel in court, arbitration and adjudication hearings and also sits as an arbitrator and adjudicator. He is listed in the panel of arbitrators of the Kuala Lumpur Regional Centre for Arbitration (KLRCA) and MIArb. He has been involved in a number of arbitration-related court cases dealing with challenges of awards which are reported in the Malaysian law journals. He is also listed in the panel of adjudicators of KLRCA. Externally, Ko Luen gained recognition in the field for his “excellent service and clear vision of what is truly best for the client†[Chambers & Partners Asia 2011]. He has also been listed in Chambers Asia [2012], Chambers (Asia-Pacific) 2013 (Construction Disputes) and Expert Guides–Construction & Real Estate (Construction) 2015.

Huey Miin has been in legal practice since his admission as an Advocate and Solicitor of the High Court of Malaya in August 1999. He holds a Bachelor of Laws degree from the University of Sheffield, England and was called to the English Bar in October 1998 as a member of the Honourable Society of Middle Temple. He is a partner of Messrs. Raja, Darryl & Loh and a member of the firm’s Dispute Resolution Practice Group. He practises corporate, commercial and civil dispute resolution and has appeared as counsel at all levels of the Malaysian courts and in arbitrations, both domestic and international, on disputes covering a diverse range of areas. He is a member of the Kuala Lumpur Regional Centre for Arbitration's arbitration, mediation and adjudication panels, a Fellow of both the Malaysian Institute of Arbitrators and the Chartered Institute of Arbitrators and serves as a member of the Malaysian Advocates & Solicitors Disciplinary Board's Disciplinary Committees. |
